Why "Signing First" is the New Standard for Delaware Homebuyers

If you’ve been out touring homes recently, you’ve likely noticed a shift in how we get started. For some, being asked to sign a Written Buyer Agreement before seeing a single property can feel like a "big step."

But here at Active Adults Delaware, we believe in doing things by the book. Today, I’m pulling back the curtain on why this "formality" is actually your greatest protection in today's market. We call it the "Three Pillars of Consumer Protection."

Pillar 1: Total Transparency (The NAR Settlement)

Since the NAR Settlement changes went into effect in late 2024, the real estate industry has moved toward total transparency. Before we ever tour a home—whether in-person or virtually—we are required to have our relationship in writing.

This ensures that there are no surprises. You’ll know exactly what services we provide and exactly how we are compensated before we even look at a kitchen or a master suite.

Pillar 2: Established Industry Standards (Bright MLS)

Our local Bright MLS rules (specifically Rule 1.12.1) back this up. The rule is clear: A written contract must be in place by the time a client is taken on a home tour. This ensures that every buyer has a dedicated advocate from the very first door we open.

Pillar 3: The Law of the Land (Delaware Licensing Law)

This is the most important part. In Delaware, your protection is written into the state code (Title 24, Chapter 29).

 

  • The CIS: Per Delaware licensing law, we must provide you with a Consumer Information Statement (CIS) at our first meeting to disclose who we represent.

  • The Fee Rule: While Delaware law "presumes" we are your agent from the start, the code specifically states that you are not obligated to pay a fee unless it is in a separate written agreement.

The "Consultant" Difference

When we ask for that signature, we aren’t just following a corporate mandate; we are fulfilling our legal duty to you. It ensures you have:
