Cleanup Certified Complete

The land under Wilhaven went through Delaware's brownfield program under state oversight, and the state has certified the cleanup complete.
Where it stands: DNREC, the state environmental agency, issued a Certification of Completion of Remedy for this land on May 28, 2026, site DE-1843, Wil King Station. It is recorded with the Sussex County Recorder of Deeds.
What was done: soil near an old dumping area was dug out and removed, and later testing found no soil above the state's screening levels. DNREC adopted the final cleanup plan on November 18, 2025.
The rule that stays with the land: a recorded environmental covenant says no groundwater well may be installed, and no groundwater drawn, on the property without written approval from DNREC. The shallow groundwater tested above state screening levels for some metals and other compounds, which is why. Ask how each home gets its water.
Ongoing oversight: the state's long-term stewardship plan calls for quarterly groundwater monitoring and scheduled site inspections, and a separate DNREC-approved plan tells construction crews how to handle groundwater during building.
The approval: preliminary site plan approved August 24, 2023, 4 to 1, the no vote over Wil King Road capacity. A six month extension was granted August 5, 2026, and a request to amend Condition F was deferred July 15, 2026 and has not come back. A 2021 request to rezone the land to medium density was denied.
We will send you the DNREC certificate and the covenant so you can read them before you buy.

About the Taxes

Read this first: Active Adults Realty is not a tax, legal or financial advisor and nothing below is advice. Confirm every figure with your own tax professional and with Sussex County before you rely on it.
The state picture: Delaware has no state sales tax, no estate tax and no inheritance tax, and Social Security is not taxed.
The local picture: Wilhaven was approved by Sussex County and sits outside any town limits, so the property tax bill is county and school tax with no town tax on top. Sussex County reassessed every property recently, so older tax figures may not reflect what you will pay.
New homes: a new home is assessed once it is finished, so the first tax bill may cover only the land.
Call 302-549-5164 and we will pull the recorded figures once homes are on the tax rolls.
